Default 2016 CX5 rebuilt 40000KM ago now saying turbo gone

Hi all we have a 2016 CX5 diesel that had a partial engine rebuild by Mazda 18mths ago and has done about 40000km since. Luckily for us at the time it didn't sh## itself we took it in for routine service and they wouldn't give it back, said it was too dangerous to drive. It took a bit of kicking and screaming for us not t pay for the rebuild but it happened, at least partially, and thanks to this forum as well. Two weeks ago we got the full system malfunction lights and it lost pretty much all power; it was over revving wouldn't change down and generally very sick. It has always been serviced at the one dealer where it was bought. It is our 2nd Mazda from the same dealership in a bit over 10yrs. When we contacted them about getting the vehicle taken into them (we are rural and 100km from the dealer) they told us to go elsewhere as they are too busy despite our pleas and disgust. We got it to the local auto electrician for diagnostics and he's reading a turbo issue, the local mechanic can't handle turbos. Just looking for thoughts on where to next please? Anyone else had a turbo issue after the rebuild?

By chance i've stumbled across this post and signed up just to give you some tips.
I had a 2013 diesel that had similar issues - it was a not-rare (yet not common) issue with the 2.2 turbo diesels and the DPFs. The DPF nature injected too much diesel that bypassed the rings and diluted the oil. the diluted oil wears everything down. Things fail. Mazda Aus played hardball with me for 9 months and then I made a website detailing all my woes. Within a week of the website going up they offered to refund me the full amount of the car after a year of ownership. I think my case is the only case I have ever come across of this happening in Australia. When I had the site up I was contacted by dozens of people with the same issue.

I don't know if your CX5 diesel has the same issue, but I wouldn't be surprised.

From what you've posted already it appears Mazda has already breached consumer law by suggesting that you have to pay for the remedy that you are entitled to for free. This is something they were taken to court over and lost https://www.accc.gov.au/media-releas...or-faulty-cars . They have a track record of doing this sort of stuff.

I suggest you wise up on Australian Consumer Law, your rights regarding your remedies and entitlements, and write a very sharp letter. Include the service manager in this letter, the dealer principal, and if you can find the email for mazda legal as well - it might be legal@mazda.com.au or something. I possibly found head of legal department's email being mrobins@mazda.com.au. I found that on rockreach. Also found ssingh@mazda.com.au being a Senior Manager Public Relations. You want your email to hit a few of these high level managers and for it to be a case of "can someone please fix this guy's car so he shuts up - we already have enough bad PR". But for them to take notice from you, you need to establish yourself as someone who knows their rights and knows how to escalate if not given the proper treatment.

You need to be keeping a sound written record of all phone calls, emails, what they have said to you on what date and time etc. You can then initiate a complaint in the tribunal court (very low cost to you) - tribunals are very fair but generally fight for the little guy in the battle if there is a strong case presented. I imagine if you initiate a tribunal then Mazda will quickly call you up and try to rectify everything without it going further.
