Default 09 mazda 5 gt -problems-help?

Three weeks ago today I bought a 09 mazda 5 gt with luxury package, I was so excited to fine the one I wanted white ext with black leather, still with the plastic on the seats it had never even been demoed-Perfect.
Over the next few days I noticed oil on my driveway I thought there was no way it could be my new car so we left for holidays. When I returned I realized that my 5 was leaking tranny fluid, so I took it in. They re-sealed the tranny pan. The next day I noticed it was still leaking, I thought there must be some residual on the undercarage. A couple days later I noticed it was deffinitely leaking. So I took it in again-they couldn't find anything! I put cardboard under the car for the nex few days and figured out that the car seems to leak more after a longer drive, so I took it in monday right after my wife returned from work. They called me the next day and said my tranny case leaking through the case and the transmission would have tobe replaced.
Then the bomb dropped! They are going to replace my tranny with a rebuilt one!

I screamed and hollered from everyone from the sale manager to the service manager and I called Mazda Canada, Everyone blamed each other and Mazda say they have fufilled their obligation by replacing the transmission and they will do nothing more! I have told them I do not want the car back as I would bet that that will not be the end of my problems with the transmission and my car in my eyes is devalued having a used transmission in a brand new car.
I even stated that this car should have never left the lot as this should have been caught on the PDI.

No one is going to do anything for me, I am thinking of trading the car in on another brand and taking some action against the dealer.

Does anyone have any ideas/comments?

I have to wonder if its even legal for them to do that, but I suppose it probably is... I would read the warrantly closely, but not really sure where you stand. I do think that its total BS if they can do that and get away with it, and I hope you get the new tranny in the end... what a crappy deal... Good luck - wish I could be of help.

Mazda and Ford made a strategic alliance whereby Mazda would give small car/ small engine technology to Ford and Ford would reciprocate by giving automatic transmission technology to Mazda. Because of their disparate sizes, Ford ended up with a 43% stake in Mazda, much higher than the stake US automakers have in other Japanese carmakers.
Ford, more than other US carmakers, outsources a large amount of its manufacturing to Mexico.
Gossip has it that as a result, the Mazda/ Ford marriage is in a rocky state, and that the technical people in each organization are barely on speaking terms.
Driving my 5 speed '99 Protege LX last January I had a "foreign object on road" incident in the New Brunswick winter hinterland which sheared off the rear O2 sensor, bent the hell out of the oilpan, covered the engine and drivebelts with oil, which took out the alternator. While I was waiting for it to be fixed (4 hours), the senior mechanic at Mazda informed me that the car (repaired) was in great shape, and that Mazdas of that vintage were far more trouble-free than current model Mazdas.
Go figure !

I know some car dealers will offer a "Don't like it, Trade In" policy..

signature mazda in the richmond auto mall has a, if your not happy-F*** O** policy! They will not even return my calls!

Well, have you thought about getting the "Refurb" and then trading it in for another car?

It might be expensive but it depends on how important it is to you.

Could also send this to head office.

I did think about this but the dealer wont even call me back!

I am shocked that they are treating you like this - especially given the current state of the economy - bad word of mouth is bad for business...

I have a blog that gets a small amount of traffic, about 50 visitors or so a day. If you write up a nice little article and PM me here, I will post it if you like. I'll drop it on my twitter too - about 5200 followers so far. Will help get the word out about your story. Probably wont do much good, but you never know I guess.

Even here in beautiful Courtenay, one is not safe from unscrupulous dealers. I tried to buy an 06 Mazda5 GT (28K, 5spd, wheel rash and a Q-panal scrape) from the local dealer. They let me walk away without moving off their 1st offer. I got a better deal from Vancouver on a perfect 07 with 10k less kms and 2 years left on the bumper to bumper. The Vanc. dealer paid ferry and taxi fees to get us to their door and a full tank of fuel to get us home. Local dealer's response: "I guess they didn't know what they had". Thanks to him, I own a beautiful, no excuses Mazda 5 GT 5 speed.

Funny thing, small world - I am in Courtenay also... We got ours from Mike at Courtenay Mazda and while they were fairly firm on their price, we did get free all season floor mats, rear bumper step plate, and a couple hundred dollars off mounted snow tires. Granted, we probably could have done better - we could have also done worse.

That dealership has been pretty good to us over all. We also have friends who bought a used MPV. More than a month after their warranty expired, they had their transmission go on them. The dealership replaced the tranny for free - something that was over and above the call of duty. Also, whenever we go in just for regular maintenance, they give us a courtesy car (usually a new 3).

I am sure they are not perfect, but at least with my experience they have been great.

Also, I am not surprised they were firm on their price - to tell you the truth I doubt many buyers will go to vancouver and they know it. I thought about going over there for ours, but at the time our daughter was 1 month old, and we just didnt have the time to do so.
